Good Graces Pharmacy Web-Based Applications Terms of Use
- Introduction
This Terms of Use Agreement (“Agreement”) governs the use of Good Graces Pharmacy (“Pharmacy”) web-based applications, including but not limited to the website, mobile application, interactive voice response (IVR), interactive text response (ITR), artificial intelligence (AI) platforms, and any additional electronic format that the Pharmacy provides (collectively, the “Services”). By accessing or using the Services, you (“User” or “Patient”) agree to be bound by this Agreement. If you do not agree, do not use the Services. - Responsibilities and Liabilities
2.1 Pharmacy Responsibilities
- Provide accurate and updated information regarding prescriptions, medication refills, and general pharmacy services.
- Maintain compliance with applicable healthcare and data privacy laws.
- Ensure reasonable security measures to protect patient information.
2.2 Patient Responsibilities
- Provide accurate and truthful information when using the Services.
- Maintain the confidentiality of login credentials and notify the Pharmacy of unauthorized access.
- Use the Services only for lawful and intended purposes.
2.3 Limitation of Liability
- The Pharmacy is not liable for any loss, injury, or damages arising from the improper use of the Services.
- The Pharmacy does not guarantee uninterrupted or error-free access to the Services.
- Users acknowledge that reliance on automated recommendations (e.g., AI, IVR, ITR) is at their own discretion and should not replace professional medical advice.
- Confidentiality & Use of Client Data
3.1 Confidentiality
- The Pharmacy will maintain the confidentiality of patient records and transactions in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable privacy laws.
3.2 Collection & Use of Data
- User data, including prescription history and medical information, may be collected to improve pharmacy services.
- Non-personal data may be used for analytics, service enhancements, and operational improvements.
- Users consent to the Pharmacy’s use of data for processing orders, customer support, and legal compliance.
3.3 Third-Party Disclosures
- The Pharmacy does not sell patient data.
- Data may be shared with third-party service providers for essential pharmacy operations (e.g., payment processors, shipping services) in accordance with privacy regulations.
- Disclosures may be made when legally required, such as in response to subpoenas or legal proceedings.
- Security & Security Events
4.1 Security Measures
- The Pharmacy implements encryption, secure access controls, and monitoring to protect patient information.
- Users should use strong passwords and secure their personal devices.
4.2 Security Breaches
- In the event of a data breach, affected Users will be notified as required by law.
- Users should report any suspected security breaches immediately to the Pharmacy.
- Intellectual Property Rights
- All content, trademarks, and software associated with the Services are the intellectual property of the Pharmacy or its licensors.
- Users may not copy, distribute, or modify any part of the Services without express permission.
- Termination & Modifications
- The Pharmacy reserves the right to modify these Terms at any time, with notice provided through the Services.
- The Pharmacy may terminate access to the Services for violations of this Agreement.
- Governing Law & Dispute Resolution
- This Agreement is governed by the laws of the State of Missouri.
- Any disputes shall be resolved through arbitration or in a court of competent jurisdiction.
